AN ACT
To amend chapter 376, RSMo, by adding thereto one new section relating to health insurance claims history.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 376, RSMo, is amended by adding thereto one new section, to be known as section 376.1600, to read as follows:
376.1600. Any health carrier, as defined in section 376.1350, providing group health insurance plans or group health benefits to an employer shall, upon request by the employer or the employer's agent of record, provide a statement of the annual claims history for each of the prior three years, or the total experience if the coverage has been in effect less than three years. Such information shall be provided within thirty days of such request and shall include the total aggregate amount of claims paid and the total number of claims filed for each annual period. Such information may be used by the employer or the employer's agent of record for the sole purpose of evaluating and marketing the group insurance program. The information provided to the employer or the employer's agent of record shall be furnished in a manner that does not individually identify any employee or any employee's family member and shall comply with all applicable federal and state privacy laws regarding the disclosure of health records.
