AN ACT

To amend chapter 302, RSMo, by adding thereto one new section relating to advanced health care directives.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 302, RSMo, is amended by adding thereto one new section, to be known as section 302.167, to read as follows:

            302.167. 1. Beginning January 1, 2006, for all persons who apply for a driver's license instruction permit or license or renewal of any such permit or license and who are at least eighteen years of age, the director shall make available an informational booklet or other informational sources on the importance of designating a health care proxy or executing an advance health care directive. The department of health and senior services shall make available information to the department of revenue for distribution to driver's license applicants.

            2. The application shall provide appropriate space for completion by the applicant to indicate whether the applicant has designated a health care proxy and/or executed an advance health care directive. If the applicant so indicates such designation of a health care proxy or the execution of an advance health care directive, the department of revenue shall indicate the existence of a designation of a health care proxy and/or the execution of an advance health care directive upon the person's driver's license; except that, such indication on the driver's license shall not include the name of a health care proxy or the contents of an advance health care directive. A sticker or other evidence of the existence of such designation and/or execution shall be issued for the license until the license is subsequently renewed. The applicant's signature on the application and completion of the appropriate section of the application shall be deemed authorization by the applicant for the department to include such existence of a health care proxy and/or advance health care directive on the driver's license of the applicant.

            3. Nothing in this section shall be construed to:

            (1) Require an applicant to designate a health care proxy or execute an advance health care directive at the time of application;

            (2) Require the department of revenue to indicate the name of a health care proxy designated by an applicant or the contents of an advance health care directive on a driver's license;

            (3) Require the department of revenue to provide legal advice or services to an applicant in the designation of a health care proxy or the execution of an advance health care directive.

            4. Indication on a driver's license of the existence of the designation of a health care proxy and/or execution of an advance health care directive shall not negate or otherwise affect the validity of any subsequent modification or revocation of such a designation or execution.
