HB 1520 -- Reproductive Health Sponsor: Wright-Jones (63) This bill allows an individual to request that a local school district's curriculum on human sexuality be audited by the State Auditor. Any school district which does not correct any deficiencies in its human sexuality curriculum will be considered as having a negative result for meeting the objectives of any school improvement plan of the district. EMERGENCY CARE FOR RAPE VICTIMS The bill establishes the Compassionate Assistance for Rape Emergencies (CARE) Act and requires every hospital and health care facility to provide sexual assault victims with medical and factual information regarding emergency contraceptives. The Department of Health and Senior Services will develop, prepare, and produce informational materials relating to emergency contraception to hospitals and health care facilities; respond to complaints; and periodically examine whether hospitals and health care facilities are in compliance. If a hospital or a health care facility is not in compliance, a fine of $5,000 per woman will be imposed. For every 30 days that a hospital or health care facility is not in compliance, an additional fine of $5,000 will be levied. BIRTH CONTROL PROTECTION ACT The bill establishes the Birth Control Protection Act which: (1) Specifies that consenting individuals have a protected interest from unreasonable governmental intrusions into their private lives in regards to obtaining and using safe and effective methods of contraception; (2) Specifies that the laws of this state will be interpreted to recognize these protected rights; (3) Prohibits governmental actors or entities from interfering in a consenting individual's right to the benefits, facilities, services, or information concerning safe methods of contraception; and (4) Prohibits any laws, rules, ordinances, taxes, or regulations that are implemented to promote public health and safety from unreasonably hindering the public's access to contraceptives. WOMEN'S HEALTH SERVICES PROGRAM Subject to appropriation, the Department of Health and Senior Services must implement by July 1, 2007, a women's health services program with the goal of reducing the number of unintended pregnancies. Family planning will include, but is not limited to: (1) Breast and cervical cancer checks; (2) Screening and treatment for sexually transmitted diseases; (3) Counseling and education on the dangers of smoking and alcohol and drug use during a pregnancy; and (4) Education on sexual coercion and violence in relationships.Copyright (c) Missouri House of Representatives
