HB 1533 -- Eminent Domain

This bill prohibits, prior to January 1, 2007, the use of eminent
domain to acquire property by a private entity and the granting
of tax abatements for any portion of property in a tax increment
financing project for which eminent domain has been utilized.
Exceptions to this prohibition include when a particular property
obtained by eminent domain is blighted and rendered a significant
hazard to public health and safety, the property is required to
provide a private way of necessity, or when a property interest
less than fee simple has been granted for the purpose of
providing products or services incidental to the function of a
publicly owned facility.

The bill contains an emergency clause.
