AN ACT

To amend chapter 414, RSMo, by adding thereto one new section relating to ethanol blend fuel.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 414, RSMo, is amended by adding thereto one new section, to be known as section 414.250, to read as follows:

            414.250. 1. On or before January 1, 2007, all motor fuel sold or offered for sale in Missouri for use in vehicles equipped to operate on gasoline shall be a fuel ethanol blend, unless the United States Environmental Protection Agency or the governor by executive order promulgates rules which prohibit, limit, or otherwise regulate the use of ethanol-blended fuels in ozone nonattainment areas, as defined by Section 107 of the federal Clean Air Act, as amended, or in an area designated as a maintenance area for ozone under Section 175A of the federal Clean Air Act, as amended.

            2. For purposes of this section, "fuel ethanol blend" means a mixture of ninety percent gasoline and ten percent fuel ethanol in which the gasoline portion of the blend or the finished blend meets the American Society for Testing and Materials - specification number D-439.
