AN ACT
To amend chapters 217 and 559, RSMo, by adding thereto two new sections relating to electronic monitoring of child sexual offenders.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapters 217 and 559, RSMo, are amended by adding thereto two new sections, to be known as sections 217.737 and 559.108, to read as follows:
217.737. 1. Notwithstanding any other provision of law whenever an offender has pleaded guilty to or been found guilty of any offense in chapter 566, RSMo, or of violating section 568.020, RSMo, when the offense involved the offender having sexual intercourse or deviate sexual intercourse with the victim, or of violating subdivision (2) of subsection 1 of section 568.045, RSMo, and the victim of that offense was less than seventeen years of age at the time the crime was committed, and the offender was placed on probation or parole, the offender shall be electronically monitored while on probation or parole. Electric monitoring shall be based on a global positioning system or other technology that identifies and records the offender's location at all times.
2. In accordance with section 217.040, the board may adopt rules relating to electronic monitoring of offenders under this section.
559.108. Notwithstanding any other provision of law, when a court grants probation or parole to an offender who has pleaded guilty to or been found guilty of any offense in chapter 566, RSMo, or of violating section 568.020, RSMo, when the offense involved the offender having sexual intercourse or deviate sexual intercourse with the victim, or of violating subdivision (2) of subsection 1 of section 568.045, RSMo, and the victim of that offense was less than seventeen years of age at the time the crime was committed, the offender shall be electronically monitored while on probation or parole.
