AN ACT

To amend chapter 192, RSMo, by adding thereto one new section relating to the establishment of the Missouri state diabetes commission.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 192, RSMo, is amended by adding thereto one new section, to be known as section 192.340, to read as follows:

            192.340. 1. There is hereby established within the department of health and senior services the "Missouri State Diabetes Commission". The commission shall consist of at least ten members that are residents of this state. The members of the council shall include, but not be limited to:

            (1) The director of the department of health and senior services, or the director's designee, who shall serve as chair of the council;

            (2) Two physicians, appointed by the Missouri state board of registration for the healing arts, with at least one physician with expertise and experience in the treatment of childhood diabetes and at least one physician with expertise and experience in the treatment of adult onset diabetes;

            (3) Two health care professionals with expertise and experience in the prevention, treatment, and control of diabetes, appointed by the governor, with the advice and consent of the senate;

            (4) One representative of the American Diabetes Association, appointed by the governor, with the advice and consent of the senate;

            (5) One representative of voluntary health organizations or advocacy groups with an interest in prevention, treatment, and control of diabetes, appointed by the governor, with the advice and consent of the senate;

            (6) Three members of the public who have been diagnosed with diabetes, appointed by the governor, with the advice and consent of the senate; and

            (7) Any additional members deemed necessary and appropriate by the director of the department of health and senior services, to be appointed by the director. Such additional members shall not exceed eight members.

            2. Members of the commission shall be appointed by November 1, 2006. Of the members first appointed to the council, six members shall serve a term of two years, and four members shall serve a term of one year, and thereafter, members shall serve a term of two years. Any additional members appointed by the director under subdivision (7) of subsection 1 of this section shall serve a term of one year. Members shall continue to serve until their successor is duly appointed and qualified. Any vacancy on the commission shall be filled in the same manner as the original appointment.

            3. Members shall serve without compensation but shall, subject to appropriations, be reimbursed for reasonable and necessary expenses actually incurred in the performance of the member's official duties.

            4. The department of health and senior services with existing resources shall provide administrative support and current staff as necessary for the effective operation of the commission.

            5. Meetings shall be held at least every ninety days or at the call of the commission chair.

            6. The commission shall:

            (1) Hold public hearings pursuant to chapter 536, RSMo, to gather information from the general public on issues pertaining to prevention, treatment, and control of diabetes;

            (2) Develop a state strategy for the prevention, treatment, and control of diabetes in this state;

            (3) Examine the needs of adults, children, racial and ethnic minorities, and medically underserved populations that have diabetes;

            (4) Identify the roles and responsibilities of health care professionals in the prevention and control of diabetes; and

            (5) Provide an annual report on the activities of the commission to the director of the department of health and senior services, the speaker of the house of representatives, the president pro tempore of the senate, and the governor by February first of every year.

            7. The department of health and senior services may accept on behalf of the commission any federal funds, gifts, and donations from individuals, private organizations, and foundations, and any other funds that may become available.

            8. Pursuant to section 23.253, RSMo, of the Missouri Sunset Act:

            (1) This section shall automatically sunset two years after the effective date of this section unless reauthorized by an act of the general assembly; and

            (2) If this section is reauthorized, this section shall automatically sunset six years after the effective date of the reauthorization of this section; and

            (3) This section shall terminate on September first of the calendar year immediately following the calendar year in which this section is sunset.
