AN ACT

To repeal section 54.040, RSMo, and to enact in lieu thereof one new section relating to county treasurers.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Section 54.040, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 54.040, to read as follows:

            54.040. 1. A candidate for election or appointment as county treasurer shall be at least twenty-one years of age, a citizen of the United States, and a resident of the state of Missouri and the county in which he or she is a candidate for at least one year prior to the date of the general election or appointment for such office. The candidate shall also be a registered voter and shall be current in the payment of all personal and business taxes. Upon election or appointment to such office, the person shall continue to reside in that county during his or her tenure in office.

            2. No sheriff, marshal, clerk or collector, or the deputy of any such officer, shall be eligible to the office of treasurer of any county.
