AN ACT
To amend chapter 565, RSMo, by adding thereto one new section relating to assisted suicide, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 565, RSMo, is amended by adding thereto one new section, to be known as section 565.048, to read as follows:
565.048. 1. No licensed health care professional shall intentionally or knowingly prescribe, dispense, or administer a lethal dosage of any substance for the purpose of assisting in the death of a human being.
2. Any licensed health care professional who violates the provisions of this section is guilty of a class D felony. If a person dies as a direct result of the administration of a lethal dosage of a controlled substance prescribed or administered by a licensed health care professional in violation of this section, such health care professional is guilty of a class A felony.
3. The provisions of this section shall not apply to any person who prescribes, dispenses, or administers a lethal dosage of a substance for the sole purpose of assisting the state of Missouri or the federal government in the lawful execution of the death penalty by means of the administration of lethal gas or lethal injection.
