AN ACT

To amend chapter 568, RSMo, by adding thereto one new section relating to failing to report suspicious photographs involving a child, with penalty provisions.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 568, RSMo, is amended by adding thereto one new section, to be known as section 568.055, to read as follows:

            568.055. 1. A person commits the crime of failing to report suspicious photographs involving a child if such person:

            (1) Develops photographs through the course of such person's employment; and

            (2) Notices a photograph that appears to such person to depict the neglect, physical abuse, sexual abuse or other pornographic depiction of what appears to such person to be a child; and

            (3) Knowingly fails to report such photograph to such person's local law enforcement agency; or

            (4) Fails to retain such photograph until such law enforcement agency has had the opportunity to inspect such photograph.

            2. As used in this section "child" means a person under the age of seventeen.

            3. Failing to report suspicious photographs involving a child for a first offense is a class A misdemeanor. For a second or subsequent offense, it is a class D felony.
