AN ACT

To amend chapter 162, RSMo, by adding thereto one new section relating to an advisory council for the education of gifted children.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 162, RSMo, is amended by adding thereto one new section, to be known as section 162.692, to read as follows:

            162.692. 1. There is hereby established the "Advisory Council for the Education of Gifted Children", which shall advise and consult with the commissioner of elementary and secondary education and the administrator of the gifted program within the division of school improvement, and shall engage in other activities as set forth in this section. The department of elementary and secondary education shall, with available personnel, facilities, and appropriations, furnish meeting facilities and staff services for the council.

            2. The advisory council shall consist of nine members who are not officers or employees of any state agency, with no more than four members being officers or employees of school districts. Each member shall have experience with or training for working with gifted students. Members of the council shall be appointed by the governor, with the advice and consent of the senate. Members shall be appointed for three-year terms and may be reappointed for one additional three-year term. Vacancies shall be filled in the same manner for the remainder of the unexpired term.

            3. The administrator of the gifted program within the division of school improvement shall serve as secretary for the council. The council shall annually elect a chair and vice-chair from its membership. Members of the advisory council shall not be compensated for their service on the advisory council, but may be reimbursed for any actual and necessary expenses incurred in the performance of their duties as members of the advisory council.

            4. The advisory council shall:

            (1) Have an opportunity to comment on rules, regulations, and policies proposed for issuance on the subject of gifted education;

            (2) Consider any problems presented to it by the commissioner and advise accordingly;

            (3) Review state plans relevant to gifted education prior to submission to duly constituted authorities;

            (4) Submit an annual report to the governor, general assembly, state board of education, children's services commission, and early childhood education commission. Such report shall be made available to news media so that the patrons of school districts may be informed regarding educational programs for gifted children; and

            (5) Select annually no more than three educational programs for gifted children operated by school districts for recognition as outstanding programs.
