AN ACT
To amend chapter 168, RSMo, by adding thereto one new section relating to the parents, tutors, and volunteers incentive program.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 168, RSMo, is amended by adding thereto one new section, to be known as section 168.625, to read as follows:
168.625. 1. The department of elementary and secondary education shall establish the "Parents, Tutors, and Volunteers (PTV) Program" to encourage volunteerism in schools by adults. The department shall utilize grant moneys available under the federal No Child Left Behind Act and moneys appropriated by the general assembly for such program.
2. Grant moneys under the program shall be available to pay for the cost of credit hours at an institution of higher education in this state for any adult who volunteers in a school for a minimum of one hundred hours. For every one hundred hours volunteered by an adult, the volunteer shall receive the cost of three credit hours of higher education from any public institution of higher education in this state at which such adult is enrolled, with such costs being paid directly to such public institution of higher education. No adult volunteer shall be eligible to receive more than one thousand dollars for the cost of credit hours of higher education in a two-year period.
3. Every school district at which an adult volunteers shall be responsible for verifying to the department the number of volunteer hours completed by such adult volunteers.
4. The department may promulgate rules to implement the provisions of this section. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2006, shall be invalid and void.
