AN ACT
To amend chapter 566, RSMo, by adding thereto one new section relating to enhanced punishment for certain crimes, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 566, RSMo, is amended by adding thereto one new section, to be known as section 566.155, to read as follows:
566.155. 1. The maximum term of imprisonment prescribed by law for any crime under this chapter or chapter 568, RSMo, may be increased by not more than ten years provided that the crime:
(1) Was one for which imprisonment could be imposed;
(2) Was committed against a child who was under the age of fourteen years at the time the offense occurred; and
(3) Was committed by a person responsible for the child's welfare as that term is defined in subsection 2 of this section.
2. "A person responsible for the child's welfare", includes the child's parent; stepparent; foster parent; guardian; an employee of a public or private residential home, institution, or agency; other person legally responsible for the child's welfare in a residential setting; or a person employed or authorized by one legally responsible for the child's welfare to exercise temporary control or care for the child.
