AN ACT

To amend chapter 565, RSMo, by adding thereto two new sections relating to human cloning, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 565, RSMo, is amended by adding thereto two new sections, to be known as sections 565.310 and 565.311, to read as follows:

            565.310. 1. As used in this section, the following terms mean:

            (1) "Human cloning", implanting or attempting to implant the product of nuclear transplantation into a human uterus;

            (2) "Human somatic cell", any human cell other than a haploid germ cell;

            (3) "Nuclear transplantation", transferring the nucleus of a human somatic cell into an oocyte from which the nucleus or all chromosomes have been or will be removed or rendered inert;

            (4) "Nucleus", the cell structure that houses the chromosomes;

            (5) "Oocyte", the female germ cell, the egg.

            2. No person or other legal entity, public or private, shall conduct or attempt to conduct human cloning.

            3. Nothing in this section shall be construed to restrict practices not expressly prohibited in this section.

            4. Any person who intentionally violates subsection 2 of this section is guilty of a class B felony and shall be subject to a civil penalty of one million dollars or three times the gross pecuniary gain resulting from the violation, whichever is greater.

            5. Nothing in this section shall be construed to give any individual or person a private right of action.

            565.311. On or before August 28, 2007, the attorney general shall prepare and submit to the judiciary and civil and criminal jurisprudence committee of the senate and the judiciary committee of the house of representatives a report that:

            (1) Describes the actions taken by the attorney general to enforce the provisions of section 565.310;

            (2) Describes the personnel and resources the attorney general has utilized to enforce the provisions of section 565.310; and

            (3) Contains a list of violations, if any, of the provisions of section 565.310.
