AN ACT
To amend chapter 192, RSMo, by adding thereto one new section relating to the women's health services program.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 192, RSMo, is amended by adding thereto one new section, to be known as section 192.969, to read as follows:
192.969. 1. Beginning July, 2007, the department of health and senior services shall establish the "Women's Health Services Program" to provide health care services, education, and screenings for low-income and uninsured women for up to one hundred fifty dollars per patient annually.
2. Subject to appropriations, the program shall include, but not be limited to, the following women's health services:
(1) Breast and cervical cancer screening;
(2) Screening and treatment for sexually transmitted diseases;
(3) Screening for human immunodeficiency virus (HIV);
(4) Patient education and prepregnancy counseling on the dangers of smoking, and the use of alcohol and drugs during pregnancy;
(5) Education on sexual coercion and violence in relationships;
(6) Prenatal care or referrals;
(7) Mammograms;
(8) Cholesterol screenings;
(9) Screening for and education on diabetes;
(10) Education of health care professionals on the unique symptoms of women regarding heart disease, which is the leading cause of death for women;
(11) Physical examination of heart, lungs, abdomen, pelvic area, skin, height, weight, and blood pressure; and
(12) Procedures to prevent cervical cancer, including colposcopy, cryosurgeries, and loop electrosurgical excision procedures (LEEP).
3. The department may utilize local health departments for the provision of such services; except that, the department shall not contract for such services or utilize any entity other than department personnel and local health departments for the provisions of such services.
4. Services under the program shall be provided on a sliding-scale fee schedule based on income as established by rule of the department. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2006, shall be invalid and void.
