HB 542 -- Commercial Solicitations

This bill prohibits businesses from sending unsolicited
commercial mail to individuals older than 65 years of age who
register with the Office of the Attorney General.  The Attorney
General is required to promulgate the necessary rules for the
creation and operation of a no-mail database by January 1, 2008,
and have the database in operation by July 1, 2008.  There will
be no charge to have one's address included in the database, and
the database will not be a public record.  The Attorney General
may seek an injunction and a civil penalty of up to $5,000 for
every violation of the no-mail law.  Any person receiving two
solicitations in a 12-month period may bring suit to enjoin the
solicitations and be awarded up to $5,000 for each violation.

The bill becomes effective July 1, 2008.
