HB 747 -- Participation in an Animal Identification System

This bill prohibits the Department of Agriculture from
participating in the National Animal Identification System
(NAIS); any component of the NAIS including premises
registration, animal identification, and animal movement tracing;
or any similar source verification system other than the current
Missouri Cattle Specific Source Verification Program (MCSSVP).
The department is prohibited from creating any data base
associated with NAIS, beyond the minimum informational
requirements of the MCSSVP.  All cooperative agreements between
the state and federal government or other states associated with
any component of the NAIS are void.  All NAIS identification
lists or related data bases compiled using federal funds under
the NAIS will be void, except disease specific data for a
specific species of livestock.

The department must notify all livestock producers whose
information about their premises has been submitted to the United
States Department of Agriculture National Premises Information
Repository without their informed consent and develop procedures
with the federal government to expunge all data that has been
collected.

The bill does not prevent the department from participating in
any program authorized by state statute.  Private identification
programs must comply with the information disclosure restrictions
specified in the bill.

No services or enticements can be offered or withheld from a
livestock owner based solely on his or her participation or
nonparticipation in any premises registration or animal
identification program.  Nonparticipation in any premises
registration or animal identification program by a livestock
owner will not be considered a crime, nor evidence of negligence
or gross negligence.
