To amend chapter 578, RSMo, by adding thereto one new section relating to animal facilities.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 578, RSMo, is amended by adding thereto one new section, to be known as section 578.411, to read as follows:
578.411. 1. Upon issuance of a court order to enter an animal facility and prior to execution of such order, the executing law enforcement agency shall notify the state veterinarian, as defined in section 267.010, RSMo, who shall accompany the law enforcement agency personnel when entering the animal facility. If after entering the animal facility the state veterinarian determines that further action is necessary to safeguard the health and welfare of the animals at the facility, the state veterinarian shall advise the issuing court as to the appropriate actions to be taken, including but not limited to removal, placement, medical treatment, or euthanasia.
2. Nothing in this section shall be construed to restrict or otherwise limit the authority of the state veterinarian or law enforcement from taking immediate action otherwise authorized under state law.
