AN ACT
To amend chapter 262, RSMo, by adding thereto one new section relating to family farms property rights protection act of 2007.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 262, RSMo, is amended by adding thereto one new section, to be known as section 262.900, to read as follows:
262.900. 1. This section shall be known and may be cited as the "Family Farm Property Rights Protection Act of 2007".
2. No state agency shall:
(1) Ban, prohibit, or otherwise restrict farmers' and landowners' rights to own, possess, breed, propagate, transport, sell, and market by hunting with firearms any of the following captive-reared gamebirds and waterfowl: pheasants, quail, chukars, exotic partridges, and properly marked captive-reared mallard ducks;
(2) Ban, prohibit, or otherwise restrict farmers' and landowners' rights on land owned, leased, or rented by such farmers and landowners that allow pheasants, quail, chukars, exotic partridges, and captive-reared mallard ducks to freely range on their land and bodies of water located on such land;
(3) Promulgate mandatory rules that require farmers and landowners to confine pheasants, quail, chukars, exotic partridges, and captive-reared mallard ducks temporarily or continuously in partial or complete enclosures or pens past six weeks of age;
(4) Promulgate mandatory rules that are not the same or more restrictive than the federal law and regulations for captive-reared mallard ducks under the Migratory Bird Treaty Act.
3. The department of agriculture may quarantine or confine the captive-reared gamebirds and waterfowl listed in subsection 2 of this section temporarily and in the case of an animal health emergency.
4. All farmers and landowners shall obtain the appropriate permits from the appropriate state agency before they can possess, breed, propagate, transport, and hunt the gamebirds and waterfowl listed in subsection 2 of this section.
