AN ACT
To repeal section 407.300, RSMo, and to enact in lieu thereof one new section relating to the registration of copper or aluminum obtained by trade or purchase, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 407.300, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 407.300, to read as follows:
407.300. 1. Every purchaser or collector of, or dealer in junk, scrap metal, or any secondhand property shall keep a register [which shall contain the name and address of the person from whom] containing a written record for each purchase or trade in which each type of metal subject to the provisions of this section is obtained for value. There shall be a separate record for each transaction involving any aluminum or copper wire [or] , cable [is purchased] , bars, ingots, rods, tubes, pipes, wires, scraps, clamps, or connectors, whatever may be the condition or length of such [copper wire or cable] metal and whether or not it is mixed or conjoined with any other substances containing the following data: A legible right thumbprint and a photocopy of the operator's license or other state-issued form of identification of the person from whom the material is obtained; the motor vehicle license number of the vehicle utilized in delivering the material; [the residence or place of business and driver's license number of such person;] the date, time, and place of and a full description of each such purchase or trade including the quantity by weight thereof[; and shall permit any peace officer to inspect the register at any reasonable time]. If the person from whom the material is obtained does not possess a valid state-issued photo identification that matches the appearance of the person, the purchaser, collector, or dealer shall take and maintain in a manner that cross references to the written record a photograph of the face of the person along with a reasonably accurate record of the person's height and weight.
2. The purchaser, collector, or dealer shall not sell, transfer, or otherwise dispose of the aluminum or copper for a minimum of fifteen days after the date on which it was obtained. If the purchaser, collector, or dealer receives any alert from a law enforcement agency, electric utility, or rural electric cooperative of the theft of copper or aluminum, the material shall be retained for an additional thirty days. Any transfer of the material to another person or entity after the required time period shall be documented and maintained in the same manner as the original transaction in which the material was obtained.
3. The records required under this section shall be maintained for a minimum of twenty-four months from when such material is obtained and shall be immediately available for inspection by any law enforcement agent or an authorized agent of any rural electric cooperative, electric utility, or railroad corporation at any reasonable time.
4. Anyone convicted of knowingly violating this section shall be guilty of a class B misdemeanor and shall be fined not less than [twenty-five] one thousand dollars nor more than [five hundred] ten thousand dollars[, or imprisoned for not less than thirty days nor more than six months, or both].
