AN ACT
To amend chapter 115, RSMo, by adding thereto one new section relating to candidate filing requirements.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 115, RSMo, is amended by adding thereto one new section, to be known as section 115.352, to read as follows:
115.352. 1. No person shall qualify as a candidate for elective public office in this state who has failed to file any disclosure report required to be filed under chapter 130, RSMo, for any previous election in which such person was a candidate. Any person who has failed to file such disclosure reports from a previous candidacy shall pay all penalties for such failure under chapter 130, RSMo, before filing for elective public office.
2. The secretary of state, in conjunction with the Missouri ethics commission, shall develop and implement a procedure by which the secretary of state may verify that any person desiring to file for elective public office has filed all required disclosure reports if such person has been a candidate in a previous election.
3. The secretary of state shall reject any written declaration of candidacy upon verification that such person failed to file such disclosure reports.
4. This section shall become effective January 1, 2008.
