AN ACT
To amend chapter 589, RSMo, by adding thereto one new section relating to sex offender treatment facilities, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 589, RSMo, is amended by adding thereto one new section, to be known as section 589.395, to read as follows:
589.395. 1. No person shall own or operate a facility for the primary purpose of providing sex offender treatment and living quarters, including temporary residence, for more than one sex offender who is required to register under sections 589.400 to 589.425.
2. This section shall not apply to any person who owns or operates a facility through a contract with a public governmental body, or to any facility owned by a public governmental body.
3. This section shall not apply to a facility which operated as a sex offender treatment facility prior to the effective date of this section.
4. Any person who violates this section is guilty of a class A misdemeanor.
