AN ACT

To amend chapter 407, RSMo, by adding thereto one new section relating to wireless telephone agreements.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.1112, to read as follows:

            407.1112. Any customer who has a wireless service agreement that includes an early cancellation fee shall be charged no more than the following amounts:

            (1) If the customer has one month remaining on his or her wireless service plan, the customer shall owe 1/24 of the cancellation fee provided in the agreement;

            (2) If the customer has two months remaining on his or her wireless service plan, the customer shall owe 1/20 of the cancellation fee provided in the agreement;

            (3) If the customer has three to four months remaining on his or her wireless service plan, the customer shall owe 1/16 of the cancellation fee provided in the agreement;

            (4) If the customer has five to seven months remaining on his or her wireless service plan, the customer shall owe 1/8 of the cancellation fee provided in the agreement;

            (5) If the customer has eight to ten months remaining on his or her wireless service plan, the customer shall owe 1/4 of the cancellation fee provided in the agreement;

            (6) If the customer has eleven to thirteen months remaining on his or her wireless service plan, the customer shall owe 1/2 of the cancellation fee provided in the agreement;

            (7) If the customer has fourteen to eighteen months remaining on his or her wireless service agreement, the customer shall owe 3/4 of the cancellation fee provided in the agreement; and

            (8) If the customer has nineteen or more months remaining on his or her wireless service agreement, the customer shall owe the entire cancellation fee provided in the agreement.
