AN ACT

To amend chapter 393, RSMo, by adding thereto one new section relating to utility service.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 393, RSMo, is amended by adding thereto one new section, to be known as section 393.265, to read as follows:

            393.265. If a customer of a regulated utility experiences an electrical outage for a period of forty-eight hours or more through no fault of the customer, the customer shall receive a twenty-five dollar credit for every twenty-four hours the electrical outage continues beyond the initial forty-eight hours; except that no such credit shall exceed a total of one hundred dollars per customer. This provision is not in lieu of other remedies customers may be allowed to pursue by law. In no event shall the costs of issuing credits be included in rates.
