AN ACT

To amend chapter 197, RSMo, by adding thereto one new section relating to the uninsured patients protection act.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 197, RSMo, is amended by adding thereto one new section, to be known as section 197.130, to read as follows:

            197.130. 1. This section shall be known and may be cited as the "Uninsured Patients Protection Act".

            2. No hospital licensed in this state shall charge for services provided to an uninsured person more than the current Medicare reimbursement rate for such services.

            3. For purposes of this section, "uninsured person" means a resident of this state who does not have access to affordable employer-subsidized health care insurance or other health care coverage. A person who is eligible for medical assistance as authorized in section 208.151, RSMo, is not uninsured for the purposes of this section.
