AN ACT

To amend chapter 311, RSMo, by adding thereto one new section relating to drinking establishments, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 311, RSMo, is amended by adding thereto one new section, to be known as section 311.315, to read as follows:

            311.315. 1. As used in this section, the following words shall mean:

            (1) "Drinking establishment", a premises which may be open to the general public, where intoxicating liquor sold by the drink is served;

            (2) "Restaurant", an establishment:

            (a) Where a permanent kitchen facility where at least commercial grade stove, sink, and refrigeration equipment are located;

            (b) Where food is served to the general public during the hours of 7:00 a.m. to 11:00 p.m.; and

            (c) That is open for the purpose of serving food to the general public at least four hours during such time period, and a staff of at least two employees are dedicated to the preparation, serving, and clean up of food items for sale to the general public;

            (3) "Underage entertainer", a person under the age of twenty-one who is solely at the drinking establishment for the purpose of presenting a live performance alone or as a member of a group.

            2. Except for underage entertainers, no person under the age of twenty-one shall be allowed inside the premises of a drinking establishment. A drinking establishment shall not include a restaurant, as defined in this section. Any person who is found violating this section shall be guilty of a class C misdemeanor.
