AN ACT

To amend chapter 167, RSMo, by adding thereto one new section relating to health screening of public school students.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 167, RSMo, is amended by adding thereto one new section, to be known as section 167.185, to read as follows:

            167.185. 1. Beginning with the 2008-2009 school year, the parent or guardian of each student enrolled in second grade and eighth grade at a public school shall provide to school personnel, by the first day of the school year, certification of a completed physical examination. The physical examination shall have been completed within the previous twelve months. The parent or guardian of any student who does not have certification of a completed physical examination by the first day of school shall have ninety days in which to submit the certification.

            2. The physical examination required in subsection 1 of this section shall be conducted by a licensed physician, authorized representative of the state department of health, or by personnel listed on a statewide registry maintained by the department of health. The physical examination shall include but shall not be limited to:

            (1) A health history;

            (2) Vision and hearing evaluation;

            (3) Hematocrit or hemoglobin tests;

            (4) Measurement of blood pressure;

            (5) Measurement of height and weight;

            (6) Asthma screening; and

            (7) Diabetes screening.

            3. The department of health, in collaboration with the Missouri State Medical Association and the Missouri Osteopathic Association shall develop a standardized physical examination form to be used when conducting the physical examination required in subsection 1 of this section. The form shall be suitable for duplication by the persons conducting the physical examination.

            4. A student shall be exempt from the school physical examination requirements of this section if the parent or guardian of the student submits a written statement declaring that the physical examination conflicts with the moral or religious tenets of the student or the parent or guardian of the student, or if a parent or guardian of the student submits a written statement declaring that they do not want the student to have the physical examination required in subsection 1 of this section.
