AN ACT

To amend chapter 301, RSMo, by adding thereto one new section relating to special license plates for persons convicted of driving while intoxicated.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 301, RSMo, is amended by adding thereto one new section, to be known as section 301.3157, to read as follows:

            301.3157. 1. Owners of motor vehicles who have been found guilty of or who have pled guilty to driving while intoxicated under section 577.028, RSMo, shall be issued a set of DWI license plates to be placed on each motor vehicle such person owns, either solely or jointly, other than an apportioned motor vehicle or a commercial motor vehicle licensed in excess of eighteen thousand pounds gross weight. The plates issued under this section shall be displayed on such person's motor vehicle or vehicles for a period of one year following the conviction for the intoxication-related offense.

            2. The license plates shall be a color designated by the department of revenue that is easily distinguishable from other license plates issued in this state. Upon such set of licensed plates shall be inscribed, in lieu of the words "SHOW-ME STATE", the word "DWI". Such license plates shall be made with fully reflective material and shall be clearly visible at night.

            3. An additional annual fee equal to that charged for personalized license plates in section 301.144 shall be paid to the director of revenue for the issuance of the license plates provided for in this section.

            4. The department of revenue shall promulgate rules as necessary to effectuate compliance with this section. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2007, shall be invalid and void.
