AN ACT

To repeal section 532.480, RSMo, and to enact in lieu thereof one new section relating to bail.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Section 532.480, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 532.480, to read as follows:

            532.480. If the prisoner be held to answer for a bailable offense, the court shall determine in what sum bail shall be given, and shall cause the prisoner to enter into a recognizance, with sufficient sureties, which recognizance shall be taken, certified and returned as provided by law in like cases; and if the prisoner does not give the required bail, the court shall make an order remanding [him] the prisoner, and shall, by such order, designate the sum in which bail shall be taken, and the court at which [he] the prisoner is required to appear, and that, on such bail being entered into, in conformity with such order and the provisions of law, the prisoner shall be discharged. It shall not be a prerequisite to bail that a criminal charge of any kind has been filed.
