HCS HB 1802 -- HEARINGS ON A STUDENT'S PARTICIPATION IN EXTRACURRICULAR ACTIVITIES SPONSOR: Kingery (Wilson, 130) COMMITTEE ACTION: Voted "do pass" by the Committee on Higher Education by a vote of 6 to 1. This substitute specifies that the appeal of a ruling on student eligibility for extracurricular activities by a school that is a member of an association that regulates extracurricular activities may bypass the administrative hearing process as long as due process has been observed. Due process includes the right to a new trial in a circuit court. FISCAL NOTE: No impact on state funds in FY 2009, FY 2010, and FY 2011. PROPONENTS: Supporters say that the Missouri State High School Activities Association needs to have a process that lets objective outsiders oversee its decisions at some point. The bill will give a student athlete access to the same process that a suspended or expelled student has. Testifying for the bill were Representative Wilson (130); and L. Joe Scott. OPPONENTS: Those who oppose the bill say that if decisions are arbitrary and capricious, they are already able to be challenged in court. The bill could result in higher legal expenses.
