Summary of the Committee Version of the Bill

HB 1849 -- MUNICIPAL ZONING VIOLATION REMEDIES

SPONSOR:  Pratt

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Local Government by a vote of 10 to 0.

Currently, the penalties for zoning violations for municipalities
in Jackson County are between $10 and $500 for each day of the
violation for the first offense, between $250 and $1,000 for each
day of the violation for the second and subsequent offenses,
imprisonment for 10 days for each violation, or both the fine and
imprisonment.  This bill changes the jurisdiction for these
penalty ranges to any city with more than 300,000 inhabitants and
eliminates the separate penalty for a willful violation.

FISCAL NOTE:  No impact on state funds in FY 2009, FY 2010, and
FY 2011.

PROPONENTS:  Supporters say that the bill makes two conflicting
statutes consistent and provides some administrative cleanup.

Testifying for the bill were Representative Curls; and City of
Kansas City.

OPPONENTS:  There was no opposition voiced to the committee.
