HB 2051 -- CHAIRMAN OF THE BOARD OF PROBATION AND PAROLE

SPONSOR:  Kelly

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Corrections and Public Institutions by a vote of 7 to 0.

If the position of Chairman of the Board of Probation and Parole
becomes vacant, this bill authorizes the Director of the
Department of Corrections to serve as or to appoint a member of
the board as the acting chairman until the Governor appoints a
new chairman.

FISCAL NOTE:  No impact on state funds in FY 2009, FY 2010, and
FY 2011.

PROPONENTS:  Supporters say that the chairman is the chief
administrator of the board.  When there is a vacancy in the
chairman's position, the board has no authority to conduct the
administrative operations.  The bill will allow the director to
fill this void.

Testifying for the bill were Representative Kelly; and Department
of Corrections.

OPPONENTS:  There was no opposition voiced to the committee.
