HB 1344 -- Secondhand Dealers

Sponsor:  Portwood

This bill defines "secondhand dealer" and "secondhand goods" and
requires secondhand dealers, commonly known as pawn shop dealers,
to provide a receipt to the seller of secondhand goods, to
maintain copies of all transactions, and to obtain certain
information relating to the goods and sellers prior to purchasing
secondhand or used personal property.  A database will be created
and maintained by a third party for the purpose of gathering
information on transactions of secondhand dealers and making it
available to law enforcement agencies.

Any person who gains access to information in the database
through fraud or false pretenses will be guilty of a class C
felony.  A person fraudulently selling property will be guilty of
a class B misdemeanor if the amount received from the secondhand
dealer was less than $50, a class A misdemeanor if the amount was
more than $50 but less than $150, or a class C felony if the
amount was $150 or more.
