HB 1795 -- Endangering the Welfare of a Child

Sponsor:  Pollock

This bill creates the crime of endangering the welfare of an
unborn child if a person ingests, injects, consumes, inhales, or
otherwise uses heroin, cocaine, LSD, or methamphetamine while she
is pregnant and knows or reasonably should have known that she
was pregnant.  Endangering the welfare of an unborn child is a
class C felony for the first offense and a class B felony for any
subsequent offense.  Any person who uses, produces, prepares,
sells, transports, tests, or analyzes heroin, cocaine, or LSD in
the presence or residence of a person younger than 17 years of
age will be guilty of endangering the welfare of a child in the
first degree.

Any healthcare provider who has reason to believe that a pregnant
woman has used heroin, cocaine, LSD, or methamphetamine may make
a report to the appropriate law enforcement agency.
