Summary of the Introduced Bill

HB 1978 -- Duties and Liabilities of Ski Area Operators and
Skiers

Sponsor:  Sutherland

This bill specifies the duties and liabilities of ski area
operators and skiers regarding the risk and legal responsibility
for any injury, death, or loss to person or property that results
from the inherent risks of skiing.  A ski area operator, a
tramway passenger, freestyler, competitor, or a skier is liable
for an injury, death, or loss to person or property caused by the
failure to fulfill his or her responsibilities and will not be
entitled to recover any damages for the injury, death, or loss.

No ski area operator will be liable for injury, death, or loss to
person or property suffered by any skier using a tubing park or
the injury, death, or loss caused by course design, maintenance,
or conditions that visual inspection should have revealed;
collision with another skier; or caused by course, venue, or area
conditions.  An operator will further be free from liability for
an injury, death, or loss of person or property suffered by any
competitor or freestyler using a freestyle terrain who is given
an opportunity to visually inspect the terrain and the inspection
should have revealed the conditions or by collision with a
spectator, competition official, ski area personnel, or another
competitor or freestyler.
