Summary of the Introduced Bill

HB 2026 -- Sexually Oriented Businesses

This bill regulates sexually oriented businesses by making the
following actions class A misdemeanors:

(1)  Knowingly and intentionally appearing nude or depicting,
simulating, or performing specified sexual activities in a
sexually oriented business;

(2)  Knowingly or intentionally appearing in a sexually oriented
business in a seminude condition unless the person is an employee
who is at least 10 feet from a customer, on a stage at least two
feet from the floor, and behind a railing no less than 24 inches
in height;

(3)  Soliciting any pay or gratuity from any customer by a
seminude employee of a sexually oriented business or any customer
paying a seminude employee; or

(4)  Touching a customer or the clothing of a customer by a
seminude employee of a sexually oriented business.

No sexually oriented business may remain open between 10:00 p.m.
and 10:00 a.m. on weekdays and Saturdays.  Sexually oriented
businesses must be closed on Sundays and all official state and
federal holidays.
