HB 2061 -- Recycling of Containers

Sponsor:  Holsman

This bill establishes provisions regarding the recycling of
containers.  In its main provisions, the bill:

(1)  Prohibits the final disposal of beverage containers by
dealers, distributors, manufacturers, and redemption center
owners in sanitary landfills;

(2)  Requires dealers or redemption centers to pay customers a
five-cent refund for the return of beverage containers.  Dealers
must accept containers of a brand sold by the dealer;

(3)  Requires the distributor of certain beverages to accept the
return of beverage containers from dealers and redemption centers
and to pay them one cent per returned container.  Distributors
must accept containers of a brand sold by the distributor.
Distributors are not required to pay a manufacturer a deposit or
refund on a nonrefillable beverage container;

(4)  Specifies that dealers, redemption centers, and distributors
are required to only pay refunds for containers less than one
gallon in size;

(5)  Establishes standards for beverage containers that must be
picked up by distributors and requires that the pick up occur
weekly or at the regular delivery time.  If a redemption center
is closed, the distributor will not be liable for missing a pick
up; and

(6)  Allows any person to open a redemption center for the return
of beverage containers subject to rules established by the
Department of Natural Resources.  Requirements for an application
to open a redemption center and for approving or withdrawing
approval for a redemption center are specified in the bill.
