Summary of the Introduced Bill

HB 2212 -- Statutory Liens Against Real Estate

Sponsor: Wasson

This bill changes the laws regarding statutory liens against real
estate, sets terms, and contains forms to be used to execute
partial or conditional and full lien waivers in exchange for
payment.

Attorney fees and costs to collect money owed will be included in
the amount for which a lien may be filed against real property.

Currently, any party claiming a lien involving rental machinery
or equipment must provide written notice to the property owner
that the machinery or equipment is being used on the property
within five business days of the start of the use of the
machinery or equipment. The bill increases the notice period
requirement to within 45 business days.
