HB 2298 -- Energy Efficient Programs

This bill allows for the creation of certain energy efficient
programs under the direction of the Missouri Public Service
Commission.  In its main provisions, the bill:

(1)  Requires energy efficiency proposals and investments that
are approved by the commission to be set forth in the relevant
corporation's tariff.  The commission may terminate its approval
of these programs and investments, but their costs will be
recoverable.  Proposals must be implemented within six months of
tariff approval unless the terms of the tariff specify a
different effective date;

(2)  Allows electric and gas corporations to recover the costs of
approved proposals and investments in rates or as ongoing
expenses or a rate base item.  Capital expenses must be recovered
as a rate base item and are carried over until the next
applicable general rate case;

(3)  Allows the commission to approve energy efficiency proposals
that are not cost-effective if they are funded by tax or other
governmental credits or incentives or by customers participating
in an approved program; and

(4)  Requires the commission to provide oversight and approve
corporation-specific settlements and tariff provisions to ensure
that electric and gas corporations can achieve the goals of the
bill.  The commission may select a consultant to assist in the
design and implementation of energy efficiency investments.
