HB 2339 -- Restroom Access Act

This bill establishes the Restroom Access Act which requires
certain retail establishments with three or more employees
working to allow customers with certain specified medical
conditions to use an employee toilet facility not available to
the public during normal business hours if the toilet facility is
reasonably safe and no public restroom is immediately accessible
to the customer.

A retail establishment or employee will not be civilly liable for
any act or omission for allowing a customer to use an employee
toilet facility if:

(1)  The employee is not willfully or grossly negligent;

(2)  The toilet facility is not accessible to the public; and

(3)  The use results in an injury to or death of the customer or
any individual other than an employee assisting the customer.

Any retail establishment or its employees violating the
provisions of the bill will be guilty of an infraction.
