HB 2505 -- Administration Tranfers between State Agencies Sponsor: Sutherland This bill transfers the administration of certain state councils, funds, and duties. BRAIN INJURIES The bill: (1) Changes the terms "head injury" and "traumatic head injury" to "brain injury" and "traumatic brain injury" as they are used in the provisions regarding head and spinal cord injuries within Chapter 192, RSMo, and injury prevention, brain injury rehabilitation, and local health services within Chapter 199; (2) Transfers administration of and appropriation for the Missouri Brain Injury Advisory Council, formerly the Missouri Head Injury Advisory Council, from the Division of General Services within the Office of Administration to the Department of Health and Senior Services. The number of members on the council is decreased, through attrition, from 25 to 18, and the authority to appoint its members is changed from the Governor to the department director. State agencies with services that impact brain injury survivors and their families are required to appoint representatives to participate on the council in an ex officio nonvoting capacity; and (3) Transfers the responsibility, subject to appropriations, of ensuring that brain injury prevention and rehabilitation evaluation, service coordination, treatment, rehabilitation, and community support services are accessible to injured participants from the Division of Injury Prevention, Head Injury Rehabilitation and Local Health Services to the Adult Head Injury Program within the department. BLINDNESS EDUCATION, SCREENING AND TREATMENT PROGRAM The provisions regarding the Blindness Education, Screening and Treatment Program are transferred from Section 192.935 to Section 209.015. DIVISION OF GEOLOGY AND LAND SURVEY The bill revises the statutes to reflect the prior name change of the Division of Geological Survey and Water Resources to the Division of Geology and Land Survey within the Department of Natural Resources. SOIL AND WATER CONSERVATION DISTRICTS The purpose and definition of a "soil and water conservation cost-share program" is expanded to include the protection of water resources of the state to preserve the productive power of Missouri agricultural land. SURPLUS LINES INSURANCE The bill: (1) Changes the method by which the Director of the Department of Insurance, Financial Institutions, and Professional Registration notifies surplus lines licensees that a surplus lines insurer is ineligible from by mail to by any public electronic format; (2) Requires the tax imposed upon insured or self-insurers who purchase surplus lines insurance from someone other than a broker to be remitted to the Department of Revenue who notifies the Director of the Department of Insurance, Financial Institutions, and Professional Registration of the moneys collected from each insured or self-insurer. Currently, the tax is remitted to the department director who transfers it to the Department of Revenue; (3) Requires brokers to submit quarterly statements, in addition to the currently required annual statements, to the department director on the gross amounts charged for surplus lines insurance and the net premiums received in the previous year; and (4) Requires the payments of taxes, penalties, and interest levied regarding surplus lines insurance laws to be remitted to the Department of Revenue who notifies the Director of the Department of Insurance, Financial Institutions, and Professional Registration of the moneys collected from each surplus lines licensee. Currently, these payments are sent to the department director who transfers them to the Department of Revenue. CRIME VICTIMS' COMPENSATION FUND The administration of the Crime Victims' Compensation Fund, including the determination and award of compensation, is transferred from the Division of Workers' Compensation within the Department of Labor and Industrial Relations to the Department of Public Safety.Copyright (c) Missouri House of Representatives
