HB 2519 -- Gift Certificates and Credit Memos

Sponsor:  Portwood

This bill prohibits any post-sale charge or fee on credit memos
and gift certificates sold in Missouri.  A gift certificate can
have an expiration date of not less than three years if it is
provided as a charitable contribution and no consideration is
given to the issuer by the consumer or not less than one year if
provided under an employee-incentive program, consumer-loyalty
program, or promotional program that is disclosed in writing and
no consideration is given to the issuer by the consumer.  A gift
certificate provided as part of a larger package for a
convention, conference, vacation, sporting event, or fine arts
event having a limited duration can have an expiration date if
most of the value paid is for the convention, conference,
vacation, or event.

These provisions do not apply to a gift certificate or credit
memo sold or issued by a financial institution or by a money
trasmitter if it is redeemable by multiple unaffiliated
merchants.
