AN ACT

To amend chapter 313, RSMo, by adding thereto two new sections relating to licenses for excursion gambling boats.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 313, RSMo, is amended by adding thereto two new sections, to be known as sections 313.833 and 313.846, to read as follows:

            313.833. 1. A holder of any license who violates the provisions of this chapter or the rules and regulations promulgated thereunder shall be subject to an appropriate administrative penalty by the commission's executive director. Each licensee subjected to an administrative penalty shall have the right to a hearing to contest any such penalty and such penalty shall not be imposed until the conclusion of any such hearing and final appeal. Such penalty may include, but not be limited to, a monetary penalty and suspension or revocation of license.

            2. The executive director shall report any such administrative penalties to the commission on a regular basis.

            3. The commission shall promulgate rules and regulations to establish penalties for violations of the applicable laws, rules, and regulations.

            4. Nothing in this section shall in any way limit the commission's authority to take emergency action deemed appropriate to protect public health, safety, and welfare when facts are sufficient to support the conclusion that an immediate threat to the public health, safety, and welfare exists.

            313.846. The gaming commission shall be prohibited from issuing any new license to operate excursion gambling boats in the state before August 28, 2011. If one or more of the licenses issued prior to August 28, 2008, expires, is not renewed, is forfeited, or revoked, the commission may issue a new license to replace the license that expired, was not renewed, was forfeited, or revoked, but such license shall only be issued for the same excursion gambling boat or another excursion gambling boat which will be located in the same or adjoining city, county, or city not within a county as the excursion gambling boat whose license expired, was not renewed, was forfeited, or revoked. Licenses issued prior to August 28, 2008, under this subsection shall include any future licenses for which the commission received an application and selected the application as a priority to be investigated to determine suitability for a license prior to December 31, 2007.
