AN ACT

To amend chapter 589, RSMo, by adding thereto one new section relating to registered sexual offenders, with a penalty provision.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 589, RSMo, is amended by adding thereto one new section, to be known as section 589.423, to read as follows:

            589.423. 1. As used in this section the following terms shall mean:

            (1) "Minor", any individual who is under eighteen years of age;

            (2) "Photograph", any picture, film, or digital photograph, motion picture film, videotape, or similar visual representation or image of a person.

            2. It shall be unlawful for any person who is required to register as a sexual offender under section 589.400 to intentionally photograph a minor without the consent of the minor's parent or guardian.

            3. Any person who violates the provisions of subsection 2 of this section is guilty of a class A misdemeanor.
