AN ACT
To amend chapter 208, RSMo, by adding thereto one new section relating to immunosuppressive drugs.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 208, RSMo, is amended by adding thereto one new section, to be known as section 208.207, to read as follows:
208.207. The MO HealthNet program shall not require prior authorization, step therapy, generic substitution, or quantity limits for an immunosuppressive drug without express written or oral notification and the documented consent of the health care professional and the MO HealthNet participant. For purposes of this section, "immunosuppressive drug" means a drug that is used in immunosuppressive therapy to inhibit or prevent activity of the immune system, and is used to prevent the rejection of transplanted organs and tissues. Immunosuppressive drugs shall not include drugs for the treatment of autoimmune diseases or diseases that are most likely of autoimmune origin.
