AN ACT

To amend chapter 49, RSMo, by adding thereto one new section relating to noise ordinances.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 49, RSMo, is amended by adding thereto one new section, to be known as section 49.700, to read as follows:

            49.700. 1. The governing body of any county without a charter form of government may enact a noise ordinance or order that:

            (1) Prohibits a person from creating amplified noise above a specified decibel level without receiving written permission at the discretion of the county commission; or

            (2) Prohibits any owner, occupant, or other person or legal entity with the legal right to use or enjoy the property from allowing another person to create amplified noise above a specified decibel level without receiving written permission at the discretion of the county commission.

            2. No noise ordinance or order enacted under this section shall supersede the immunities granted to the owners of firearm ranges under section 537.294, RSMo, or to hunting preserves nor shall the discharge of firearms for lawful purposes be prohibited under this section.

            3. No governing body of any county of the first, second, third, or fourth classification shall have the authority to enact any noise ordinance or order under this section that governs any noise made by any railroad company, telecommunications or wireless company, public utility, rural electric cooperative, municipal utility, or any agricultural operation.
