AN ACT
To amend chapter 37, RSMo, by adding thereto one new section relating to audits by the office of administration, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 37, RSMo, is amended by adding thereto one new section, to be known as section 37.900, to read as follows:
37.900. 1. The office of administration shall conduct random audits of any contractor or subcontractor performing publicly funded construction projects in this state to:
(1) Ascertain the legal status of the contractor's and subcontractor's workers; and
(2) Ensure that the laws regarding prevailing wages, under sections 290.210 to 290.340, RSMo, are being met.
2. If such audit reveals that a contractor's or subcontractor's workers are illegal aliens or that the laws regarding prevailing wages are not being met, the office of administration shall impose a fine against such contractor or subcontractor of up to one thousand dollars for every day such contractor or subcontractor employs an illegal alien or fails to comply with the laws regarding prevailing wages.
3. As used in this section, "publicly funded construction projects" include state projects, county projects, local projects, or district projects, including school districts, and projects involving roads, highways, bridges, sewer and water lines, storm sewers and drainage projects, and public buildings of any type.
