AN ACT

To amend chapter 173, RSMo, by adding thereto one new section relating to instructional costs at public institutions of higher education.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 173, RSMo, is amended by adding thereto one new section, to be known as section 173.950, to read as follows:

            173.950. 1. Beginning with the fall term of academic year 2009-2010, a student at a public institution of higher education who enrolls in the same undergraduate college-credit course more than twice shall pay tuition at one hundred percent of the full cost of instruction, based on the institution's cost of such courses. Students who withdraw or fail a class due to extenuating circumstances may be granted one exception for each class, provided that approval for the exception is granted according to policy established by the governing board of the institution.

            2. Governing boards of institutions may make exceptions to this section for individualized study, courses that are repeated with the same course number designation but different content as a requirement of a major, and courses that are intended as continuing over multiple semesters; such exceptions shall not include the taking of course work more than two times to increase grade point average or to meet minimum course grade requirements.
