AN ACT
To amend chapter 578, RSMo, by adding thereto one new section relating to canned hunting, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 578, RSMo, is amended by adding thereto one new section, to be known as section 578.013, to read as follows:
578.013. 1. No person who owns, operates, or manages a facility that harbors animals shall knowingly permit:
(1) The taking on such premises by any person who pays a fee to take a live animal by any of the following means:
(a) The shooting or spearing of an animal that is tied or hobbled;
(b) The shooting or spearing of an animal that is staked or attached to any object;
(c) The shooting or spearing of an animal that is confined in a box, pen, cage, or similar container or in a fenced or other area from which there is no reasonable means for such animal to escape;
(d) The deliberate release of an animal that is confined in a box, pen, cage, or similar container or in a fenced or other area from which there is no reasonable means for such animal to escape in the presence of any person who is, or will be, shooting or spearing such animal;
(2) For purposes of this section:
(a) "Shooting" shall mean the discharge of any type of firearm or bow and arrow; and
(b) "Spearing" shall mean the use of any hand or mechanically propelled single or multiple pronged pike, blade, or harpoon.
2. Nothing contained in this section shall be deemed to prohibit:
(1) The lawful taking, hunting, or trapping of an animal; or
(2) The lawful slaughtering of an animal; or
(3) The killing of an animal that is menacing in a manner likely to cause serious injury or death to human beings.
3. Any person violating this section shall be subject to a fine not to exceed five hundred dollars for the first violation. Any second or subsequent violation of this section shall result in a fine not to exceed one thousand dollars or imprisonment not to exceed one year, or both.
