2. The state fire marshal shall by rule or regulation establish the procedures for licensing fire sprinkler installer contractors, fire sprinkler installers, and fire sprinkler installer assistants. Such rules and regulations shall include but not be limited to establishing licensing procedures, examination fees, and causes for suspension or revocation of licenses or the levying of civil penalties for violations.
3. No person shall install, inspect, dismantle to terminate service, maintain, or repair, any fire sprinkler system unless such person is licensed by the state fire marshal.
4. The provisions of this section shall not apply to any municipal county or state employee while in the performance of their duties or anyone licensed as an engineer in this state.
5. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo.
